Profit At Any Cost: How Banks Help Drug Traffickers and Terrorists
After years of scandals and abuses, it's hard to be surprised by the criminal behavior of major banks. Typically, though, exposes of bank wrongdoing have focused on their financial shenanigans.
But yesterday, thanks to the dogged work of Senate investigators, we learned that the criminality of some banks goes much deeper, with these institutions servicing drug traffickers and terrorist-linked entities, and circumventing U.S. laws governing ties with rogue states like Iran, Sudan, and North Korea.
All to boost the bottom line.
A new report by the Senate Permanent Subcommittee on Investigations, chaired by Carl Levin, focuses on HSBC and how the global bank, along with its large U.S. affiliate, has flouted federal laws aimed to stopping criminals and terrorists from gaining access to the American financial system.
The report is chock full of acronyms and makes for turgid reading. But dig through the dry, technical prose and a truly shocking picture emerges. Investigators found, among other things, that:
- HSBC systematically turned a blind eye as its branch in Mexico served as the conduit for moving billions of dollars in cash into the United States even as U.S. and Mexican authorities expressed repeated concern that such a large volume of dollars could only come from drug cartels.
Even Google's Schmidt conceded that better use of information isn't enough.
"I think at the end of the day, there really are bad people, and you have to go in and arrest them and kill them," he said.
The conference in Westlake Village, Calif., was organized by Google's think tank, Google Ideas, and the Council on Foreign Relations.
Participants included Ian Biddle, an arms broker; former Homeland Security chief Michael Chertoff; Ron Noble, secretary general of Interpol, the international police agency; Anthoney DeChellis, CEO of Credit Suisse private banking; and Juan Pablo Escobar, son of the slain Colombian drug lord Pablo Escobar. Two years ago, for instance, Barclays -- a bank very much in the news today -- paid a $298 million penalty to the U.S. government for violating anti-money laundering laws as a result of a global probe that investigated many other banks. As the Wall Street Journal reported:
Nine banks have been caught up in the probe, and some are in discussions to settle, according to a person familiar with the case. Three have already. Last month, Barclays PLC in London agreed to pay $298 million and admitted to allowing payments on behalf of clients in Cuba, Sudan and other countries. Lloyds Banking Group in London and Credit Suisse Group in Zurich—banks that operated extensive transfer systems for Iranian clients—have agreed to settlements totaling $350 million and $536 million, respectively.
These weren't rogue operations. The investigators discovered that the banks ran dedicated units to systematically aid the undetected transfer of money through the U.S. banking system. They did that by removing identifying coding on fund transfers so they could evade automated U.S. bank computer systems designed to spot money flowing from a sanctioned state...

the consensus rule" as a condition for reaching an agreement.
"The government of Mexico decries the U.N. diplomatic conference postponing the adoption of the Arms Trade Treaty," the foreign ministry said in a communique.
On Friday, the 193 participating countries finished their United Nations meeting "after a month of intense negotiations" but unable to reach a consensus on the final text that would have created "new international standards" for regulating the trade in conventional arms worldwide, the foreign ministry said.
"Faced with the lack of positive results, Mexico regrets that the imposition of the consensus rule makes it impossible to reach agreement despite the wide and obvious support for the measure, which can thereby be made null and void by a small minority of countries," the foreign ministry said.
Negotiations were going well but were derailed when the United States asked for "more time" to study the last draft that had been agreed upon last Thursday, and due to the objections of other great powers like China and Russia.
Despite the fruitless result, "Mexico wishes to stress that the conference did make considerable progress on a draft of the text that should be improved and strengthened...within the United Nations General Assembly," the foreign ministry said.
For Mexico, a "strong, sturdy" international treaty is necessary to end "the lethal situation that many societies suffer on every continent from the irresponsible sale and shipment of arms and munitions."
At the international conference's final session, Mexico read a statement "in the name of 87 delegations from all regions, in which it urged that efforts not be abandoned to finish negotiating the treaty at the next U.N. General Assembly."
Finally, Mexico announced that "it will continue giving the greatest importance to this subject and will continue to work with like-minded countries, as it did throughout this conference and during the preparatory meetings."
"Mexico wishes the U.N. to pass the treaty that the international community needs: a strong, effective treaty that bans the trade of conventional weapons when they risk being used to commit grave violations of international law, and that establishes mechanisms to prevent arms from being shifted to the illegal market," the communique said.
Mexico is one of the countries most damaged by the illicit trade in arms, which are sold legally in the United States but frequently end up in the possession of drug cartels and organized crime groups operating in this country.
Combating these groups has been a priority for Mexican President Felipe Calderon, who imposed the strategy of all-out war on organized crime with the army in the streets, and who will step down from office next Nov. 30. EFE

WESTLAKE VILLAGE, Calif. (AP) — Google, so far, has won the search
engine wars. Now it wants to target international crime, including
Mexico's powerful drug cartels.Eric Schmidt, Google Inc.'s executive chairman, has taken a keen interest in Mexico, where more than 47,500 people have been killed in drug-related violence since President Felipe Calderon launched an offensive against the cartels in 2006. Schmidt recently visited most of Mexico's most violent cities, Ciudad Juarez, where civic leaders asked if he could help.
"Defeated, helpless, these people have been so hardened in their experience with cartels that they have lost battles and they have lost hope," Schmidt told a conference on international crime this week. "They were looking for a universal hammer to protect them. For me the answer was obvious. It was technology."
Experts told the conference that Mexico's cartels often use more sophisticated technology than law enforcement. Cartel assets include mapping software that tracks the location of police from high-tech control rooms; remote control submarines; and military grade rocket launchers.
Drug-dealing organizations can intercept satellite feeds, including images broadcast by intelligence agency drones. They run money laundering networks that handle an estimated $25 billion a year in drug profits.
"It's a technological arms race, and at this moment they're winning," said Marc Goodman, founder of Future Crimes, who studies the nexus of technology and transnational crime. "But there's never been an operating system that hasn't been hacked."
Google's immense intelligence assets can be brought to bear on the cartels, Schmidt suggested.
Google's ideas include creating a network so citizens can safely report cartel activity without fear of retribution. It wants to make sharing real-time intelligence easier among police in different regions. It can identify how individuals are connected to each other, to bank accounts and even to corrupt government officials. It can create community Web platforms for citizens to share information and name and shame criminals.

Just 20 percent of crimes in Mexico are reported because victims fear retaliation and don't trust the authorities, said Mexico's interior minister, Alejandro Poire. He challenged technology experts in the crowd to develop an application that would allow Mexican citizens, 80 percent of whom have cellphones, to report crimes anonymously to a call center that would direct officers to respond. Ideally, the system would allow watchdog groups to monitor police responses, he said.
Mexico's undersecretary of information technology, Francisco Niembro, said the government has been developing a Web platform where law enforcement can get a national look at crimes and investigations. Today, he said, 8,500 of Mexico's 36,000 federal police are dedicated to gathering intelligence — but analyzing that intelligence takes sophisticated staffing.
Nancy Roberts, a defense analysis professor at the Naval Postgraduate School in Monterrey, Calif., noted that in Mexico, police officials can tap phones, use tracking devices and tap into computer networks. But that does little unless someone can sort through the evidence.
"Our jobs are making sense of all the data so law enforcement knows how, when and where to strike," she said.
Eduardo Guerrero, a Mexico City-based security consultant, wasn't optimistic that technology alone can disrupt narcotraffickers.
"You should never underestimate the power of these guys," Guerrero said. "They're probably even aware of what's going on here, and will figure out a way to use it to their advantage."
Even Google's Schmidt conceded that better use of information isn't enough.
"I think at the end of the day, there really are bad people, and you have to go in and arrest them and kill them," he said.
The conference in Westlake Village, Calif., was organized by Google's think tank, Google Ideas, and the Council on Foreign Relations.
Participants included Ian Biddle, an arms broker; former Homeland Security chief Michael Chertoff; Ron Noble, secretary general of Interpol, the international police agency; Anthoney DeChellis, CEO of Credit Suisse private banking; and Juan Pablo Escobar, son of the slain Colombian drug lord Pablo Escobar. So is it really surprising we're involved in drug war.
Our General McCafferey warns us not to smoke dope,
So spaced out lie gives away classified information to the Mexican drug general who runs guns and coke,
The fact that McCafferey wasn't fired shows there isn't much hope,
Bush and Clinton's Mexican political friends,
The Gortari's dealt in everything until political fighting within,
While banks like Citicorp and Texas Commerce laundered their money with a grin,
If you ask Texas Commerce how it came to launder 9 million dollars from drug czar Massieu,
They'll just say,
They thought he made his money the old-fashioned way,
It really just exposes an American and European tradition,
Of using American and European banks to bribe corrupt
Third World politicians,
Meanwhile Mexican president select Colosio,
Is blown away with a Texas gun smuggled into Mexico,
Latin drugs could never kill,
With the efficiency our guns do and will,
Nicaraguan contras sold cocaine freely in the ghettos of L.A.,

It wasn't surprising Afghan hash flooded the U.S. market again,
While the truly corrupt money continues to get through,
Big Brother keeps its eyes on me and you,
The drug-industry keeps its billions flowing with its big business and political disguises,
While government watches a few dollars sent south by poor immigrant laborers using drugs as one of its guises,
While illegal drugs continue to buy more guns for thugs in American streets and ghettos,
Making former prohibition violence seen like sweet mementos,
American politicians have themselves to congratulate,
They've converted the American ideal into a Pan-American police state,
And no drug addict for help will ever ask,
Because a colder crueler government demands they hide behind a mask,
While all funds that might be used for the detox programs,
Are given to the CIA and DEA for their drug pogroms,
The U.S. trades its guns for drugs,
Creating anarchy and arming thugs,
Drugs and money flow north while weapons flow south,
But don't think about it just shut your mouth,
It's supply side economics to an extreme,
So that criminals get rich-things aren't what they seem
