An alleged conspiracy to dispose of more than $18‐million in stolen securities and counterfeit bonds was described here yesterday in a Federal indictment aginst a reputed Mafia lieutenant, a British lord's son and an Austrian who said he had contacts in the Vatican.
The indictment charged 16 defendants with conspiring, in “a pattern of racketeering activity,” to distribute the securities in California, Panama, Belgium, Germany, Italy and Switzerland.
Three of the defendants, including Vincent Rizzo, previously identified by the Government as a lieutenant in the crime “family” of the late Vito Genovese, were also named in state indictment on charges of extorting payments for securities with murder threats.
Ernest Shinwell, the 54‐yearold son of Lord Shinwell, was named as a defendant in the Federal indictment, which alleged a scheme for “the fencing and illegal distribution” of; $3.7‐million in stolen securities and $14.5‐million in counterfeit bonds.
Lord Shinwell was known as Emanuel Shinwell during a colorful career in Parliament before he was made a’ life peer in 1970. His son, Ernest, who describes himself as a business consultant in London, has served prison ‘terms for fraud and forgery.
Yesterday's conspiracy indictment alleged that the securities scheme included an attempt to dispose of the counterfeit corporate bonds through a contact that Leopold Led! of Vienna claimed to have in the Vatican.
Federal and state prosecutors in the case stressed that no criminal charges were made against anyone connected with the Vatican and that the Austrian defendant's claim about contacts was unsubstantiated.
The indictments were announced by Edward M. Shaw, head of the Joint Strike Force Against Organized Crime here, and District Attorney Frank S. Hogan of Manhattan.
Wiretaps by Prosecutor
Alfred J. Scotti, Mr. Hogan's chief assistant, said the indictments resulted from an 18month investigation that began with court‐authorized wiretaps obtained by the District Attorney's office. Federal authorities were asked to join the case later because of its international aspects.
Mr. Shaw credited the Federal Bureau of Investigation with conducting an “extraordinarily comprehensive and painstaking investigation.”
William I. Aronwald, Mr. Shaw's assistant, who presented the Federal case to the grand jury, said that the scope of the distribution conspiracy was indicated by charges that the defendants had received millions of dollars in stolen securities from 11 different thefts between February and November of 1970.
According to the 20‐page Federal indictment, the securities were stolen from New York offices of the Manufacturers Hanover Trust Company and Merrill Lynch, Pierce, Fenner & Smith, as well as from nine interstate mail shipments.
Treasury Bills Solen
The stolen securities included United States Treasury bills in addition to common stock of International Business Machines, the Occidental Petroleum Corporation, Benefical Finance Company, Coca‐Cola Bottling Company of Los Angeles and Norton Simon, Inc.
The indictment stated that the defendants “arranged, on a continuing basis, to obtain and receive many millions of dollars worth of stolen and counterfeit securities and to distribute them in Europe, Panama and the United States.”
“In or about the spring of 1971,” the indictment said, “the defendant Manuel Richard Jacobs (of Los Angeles) arranged to provide approximately $14.5‐million worth of counterfeit American ‘blue chip’ bonds to defendant Leopold Ledl, who represented that he would dispose of said bonds through a source within the Vatican, Rome, Italy, who, according to Led!, had specifically requested counterfeit bonds.”
Mr. Jacobs's wife, Evelyn, and his son, Jerry, also were named as defendants, but there was no indication of who was supposed to be Mr. Ledl's claimed Vatican source.
Unsuccessful Moves Recounted
After the counterfeit bonds were taken from California to Europe in July, 1971, the indictment said, several defendants “traveled from Rome to Turin, then to Milan and back to Rome in an unsuccessful effort to dispose of the counterfeit bonds through the source that the defendant, Led!, stated he had in the Vatican.”
The indictment added that another unsuccessful move to dispose of the bonds was made through an Italian defendant, Mario Foligni, who was supposed to use the services of the Vatican Bank in Rome.
“In order to test the acceptability of said counterfeit bonds,” the indictment went on, “the defendant, Mario Fo ligni, then opened an account at the Handels Bank if Zurich, Switzerland, in his name and in the name of Monsignor Professor Avocato Mario Fornasari.”
This move failed, the indictment said, when the Zurich bank “advised the defendant Mario Foligni that said bonds had been determined to be counterfeit.”
Vincent Rizzo, who is 41 and lived in Manhattan before being sentenced last May to 15 years in prison for cocaine dealing, was described in the indictment as more successful in disposing of stolen securities, including $560,000 in Treasury bills that were sold through a Los Angeles brokerage concern.
Another defendant, Peter Raia of North Bergen, N. J., was arrested by the F.B.I., which described him as a leader of the conspiracy.
The remaining American de‐ fendants were identified as William Benjamin of Philadelphia, Louis Gittleman of Los Angeles, Dominick Mantel of Emerald Hills, Fla., and Patty Marino of Manhattan, in addition to the three members of the Jacobs family of Los Angeles.
Lord Shinwell's son was identified as a defendant who pledged stolen stock certificates as security for a loan from a bank in Panama.
The other foreign defendants were identified as Tommaso Amato, Remegio Begni and Marina Neubert, all of Italy, and Hyman T. Grant of London, in addition to Leopold Ledl of Vienna and Mario Foligni of Rome.
If convicted, each defendant could face up to 20 years in prison and $25,000 in fines on the principal conspiracy charge, according to the prosecutors, who said efforts would be made to extradite the foreign defendants for trial here.
